If you, the Customer, are buying a customised and prescription product, please ensure you have read and understand our prescription terms and conditions. We, the supplier, must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by SunglassesUK.com, SunglassesUK.com will confirm that your order has been accepted by sending an email to the email address provided in the order form. 2.1 SunglassesUK.com reserves the right to refuse acceptance of the order for any reason including, without limitation and whether or not payment has been received by SunglassesUK.com, if: 2.1.1 SunglassesUK.com has insufficient stock to deliver the goods you have ordered; 2.1.2 SunglassesUK.com do not deliver to your area albeit all best endeavours will be considered in this regard; or 2.2 If SunglassesUK.com do refuse your order SunglassesUK.com will notify you by e-mail and will re-credit to your account any sum deducted by SunglassesUK.com from your credit /debit card as soon as possible but in any event within 7 days of your order subject to any bank time restraints and/or restrictions. SunglassesUK.com will not be obliged to offer any additional compensation for the inability to complete an order due to the circumstances detailed above.

Right to terminate the contract

4.1 The Customer may terminate the contract with SunglassesUK.com for the goods ordered at any time up to the end of the seventh working day from the day after the date the Customer receives the ordered goods. The Customer does not need to give SunglassesUK.com any reason for terminating the contract, nor will the Customer have to pay any penalty other than postage of the products purchased for their return. 4.2 To terminate the contract, the Customer must notify SunglassesUK.com in writing. 4.3 If the Customer has received the goods before the termination of the contract then the Customer must return the goods back to SunglassesUK.com’s contact address at the Customers own expense and risk. If the Customer terminates the contract but SunglassesUK.com have already processed the goods for delivery the Customer must not unpack the goods or unreasonably affect the external packaging of the product to ascertain the content when they are received by the Customer and must return the goods back to SunglassesUK.com at SunglassesUK.com’s contact address at the Customers own expense and risk as soon as possible. 4.4 Once the Customer has notified SunglassesUK.com that they are terminating the contract, any sum debited to SunglassesUK.com from the debit/credit card will be re-credited to your account as soon as possible and in any event within 7 days of the order allowing for any bank time restraints or restrictions. 4.5 If the contract is terminated but the return the goods to SunglassesUK.com in the condition that they were despatched when delivered to the Customer or do not pay the costs of delivery, SunglassesUK.com shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you. Should the goods not be returned within 7 days of the credited amount being returned, then SunglassesUK.com reserve the right to seek recovery of all reasonable expenses made in having to recover monies, including that available through the Courts

Delivery of goods to you

5.1 SunglassesUK.com will deliver the goods ordered by the Customer to the address provided SunglassesUK.com for delivery at the time the Customers makes the order. It is the responsibility of the Customer to ensure the correct details are provided 5.2 Delivery will be made as soon as possible after the order is accepted and in any event within 28 days of your order. 5.3 The Customer will become the owner of the goods ordered when they have been delivered Once goods have been delivered they will be held at the Customers own risk and SunglassesUK.com will not be liable for their loss or destruction.

Liability

6.1 If the goods SunglassesUK.com deliver are not what the Customer ordered or are damaged or defective or the delivery is of an incorrect quantity, then (except where you are dealing as a consumer within the meaning of the Unfair Contract Terms Act 1977) SunglassesUK.com shall have no liability unless you notify SunglassesUK.com in writing at SunglassesUK.com’s contact address of the problem within 10 working days of the delivery of the goods in question. 6.2 If you do not receive goods ordered within 28 days of the date on which they were ordered, then (except where you are dealing as a consumer) SunglassesUK.com shall have no liability unless notified in writing at SunglassesUK.com’s contact address of the problem within 40 days of the date on which you ordered the goods. If the Customer notifies a problem to SunglassesUK.com under this condition then at the Customers option SunglassesUK.com will either: 6.2.1 Make good any shortage or non-delivery; 6.2.2 Replace or repair any goods that are damaged or defective upon return of the goods; or 6.2.3 Refund to the Customer the amount paid for the goods in question by debit/credit refund or cheque And (except where you are dealing as a consumer) SunglassesUK.com shall have no further liability to the Customer. 6.3 Save as precluded by law and except where the Customer are dealing as a consumer, SunglassesUK.com will not be liable for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem notified to SunglassesUK.com under this condition and SunglassesUK.com shall have no liability to pay any money by way of compensation other than to refund the amount paid for the goods in question under clause 6.2.3 above. 6.4 The Customer must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from SunglassesUK.com’s site. The importation or exportation of certain of SunglassesUK.com’s goods to the Customer may be prohibited by certain national laws. SunglassesUK.com make no representation and accept no liability in respect of the export or import of the goods purchased. 6.5 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights the Customer might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit SunglassesUK.com’s liability for any death or personal injury resulting from SunglassesUK.com’s negligence.

Notices

Unless otherwise expressly stated in these terms and conditions, all notices from the Customer to SunglassesUK.com must be in writing and sent to SunglassesUK.com’s contact address at sale@sunglassesuk.com and all notices from SunglassesUK.com to you will be displayed on SunglassesUK.com’s website.

Events beyond SunglassesUK.com’s control

SunglassesUK.com shall have no liability to the Customer for any failure to deliver goods ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond SunglassesUK.com’s reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident or considered an Act of God.

Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which SunglassesUK.com exclude SunglassesUK.com’s liability), the enforceability of any other part of these conditions will not be affected to the extent that they are capable of continuing in force without the unenforceable term or condition.

Privacy

The Customer acknowledges and agrees to be bound by the terms of SunglassesUK.com’s privacy policy.

Third Party Rights

Except for SunglassesUK.com’s affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Governing Law

The contract between SunglassesUK.com shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between SunglassesUK.com.

Customs

When ordering goods from Sunglassesuk.com for delivery overseas, the Customer may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by the Customer; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so should contact local customs office for further information. Additionally, please note that when ordering from Sunglassesuk.com, the Customer is considered the importer of record and must comply with all laws and regulations of the country in which receiving the goods. Prescription Sunglasses.

Prescription orders are customised for you. They may take a few weeks to build (typically 7 working days). You cannot return the product for an exchange or refund.

If the products are the subject of any warranty or guarantee given by the manufacturers or suppliers of those products, we guarantee that such products will be free from defects caused by faulty materials or poor workmanship for the period of that warranty or guarantee. Where the products are not the subject of any warranty or guarantee given by the manufacturers of those products and the Customer wishes to reject the products for whatever reason, then SunglassesUK will accept the return of the products provided that the Customer returns the products to us within 7 days of them being delivered. They must also include all original packaging and documentation. Any damage or loss to either the product, packaging or the documentation may affect the amount of refund made. b.
